Terms of Service

Pineda Property Maintenance LLC

These Terms of Service govern all services provided by Pineda Property Maintenance LLC (“Company”) to its clients (“Client”). By accepting an estimate, scheduling services, or submitting a form through our website, the Client agrees to the following terms.


1. Estimates and Acceptance

All estimates provided by Pineda Property Maintenance LLC are based on the information available at the time of inspection and are subject to change due to site conditions, material availability, or labor requirements.

Estimates are valid for a limited time unless otherwise stated.

Acceptance of an estimate, scheduling services, or payment of a deposit constitutes agreement to these Terms of Service.


2. Deposits and Payment Terms

A deposit may be required to secure scheduling, labor, and materials for certain projects. Deposit amounts are determined at the discretion of Pineda Property Maintenance LLC.

The remaining balance is due upon completion of the work unless otherwise agreed in writing.

Invoices are due upon receipt unless otherwise stated on the invoice.


3. Late Payments

Invoices not paid within 30 days of the invoice date may be subject to a 2.5% monthly late fee applied to the outstanding balance.

Pineda Property Maintenance LLC reserves the right to suspend services, delay scheduling, or withhold future work for accounts with outstanding balances.


4. Cancellation and Scheduling

Once an estimate has been accepted, scheduling of labor, equipment, and materials begins.

If a client cancels a project after accepting an estimate, Pineda Property Maintenance LLC reserves the right to retain up to 30% of the project cost to cover administrative time, scheduling commitments, and materials that may have already been ordered.


5. Change Orders

Any additional work requested beyond the original estimate will require a change order and may result in additional charges.

Change orders must be approved by the client before additional work is performed.


6. Client Responsibilities

Clients are responsible for the following:

• Providing clear and safe access to work areas

• Securing pets during service visits

• Ensuring adequate watering of newly installed plants

• Identifying private underground utilities, irrigation systems, drainage lines, or obstacles prior to work

Failure to meet these responsibilities may result in delays, additional charges, or voiding of plant warranties.


7. Plant Warranty

Plant material warranties are provided under the separate Pineda Property Maintenance LLC Plant Warranty Policy.

The plant warranty applies only to qualifying plant material installed by Pineda Property Maintenance LLC and is subject to the conditions, exclusions, and care requirements outlined in the warranty document.

Failure to follow plant care instructions or maintain proper watering may void warranty coverage.


8. Weather Delays

Landscaping work is dependent on weather conditions.

Pineda Property Maintenance LLC reserves the right to delay or reschedule services due to unsafe weather conditions, excessive rain, frozen ground, or other environmental factors that may affect the quality or safety of the work.


9. Underground Utilities

While public utility companies may mark certain underground lines, clients are responsible for informing Pineda Property Maintenance LLC of any private underground utilities such as irrigation systems, drainage lines, invisible fencing, low-voltage lighting, septic systems, or other underground structures.

Pineda Property Maintenance LLC shall not be responsible for damage to private utilities that were not disclosed prior to work beginning.


10. Unforeseen Site Conditions

Landscaping work involves digging and excavation which may uncover hidden obstacles such as buried rocks, construction debris, tree roots, underground structures, or unmarked utilities.

If unforeseen site conditions are encountered that increase labor, equipment use, or materials required, Pineda Property Maintenance LLC reserves the right to adjust pricing accordingly. Any additional work will be communicated to the client whenever possible before proceeding.


11. Drainage Disclaimer

Landscaping services provided by Pineda Property Maintenance LLC do not guarantee correction of existing drainage or water management issues unless drainage work is specifically included in the written estimate.

The company is not responsible for water accumulation, soil movement, runoff, or drainage problems caused by pre-existing grading conditions, neighboring properties, weather events, or underground soil conditions.


12. Pre-Existing Conditions and Holiday Decorations

Pineda Property Maintenance LLC is not responsible for damage to pre-existing structures, materials, or utilities that are deteriorated, improperly installed, or hidden below the surface and not reasonably visible prior to work.

While care is taken during all installations and services, landscaping work involves excavation and the use of equipment which may interact with unknown or concealed elements.

Holiday Decorations and Wreath Installation Disclaimer

Installation of holiday decorations, including wreaths, garlands, and lighting, may require attachment to exterior surfaces such as siding, trim, doors, columns, or other structural elements.

While Pineda Property Maintenance LLC takes reasonable care during installation and removal, the Company is not responsible for normal wear and tear, minor holes, marks, discoloration, or damage to siding, trim, paint, or other surfaces that may occur as a result of installation, seasonal exposure, or removal of decorations.

Certain materials, including vinyl siding, wood trim, painted surfaces, or aged materials, may be more susceptible to marking or damage during installation or removal. By proceeding with holiday decoration services, the Client acknowledges and accepts these risks.


13. Limitation of Liability

Pineda Property Maintenance LLC shall not be liable for damages resulting from conditions beyond its control including but not limited to weather events, soil conditions, underground obstacles, pest activity, irrigation system failures, or improper maintenance after installation.

The Company’s liability, if any, shall be limited to the cost of the services provided.


14. Website Use

Use of this website and submission of forms does not guarantee service.

Submitting a request for an estimate constitutes consent for Pineda Property Maintenance LLC to contact you regarding your inquiry.


15. SMS Communication Consent

By submitting your information through our website forms, you consent to receive SMS text messages from Pineda Property Maintenance LLC regarding appointment scheduling, service updates, and project communication.

16. Photo and Media Authorization

Pineda Property Maintenance LLC reserves the right to photograph project areas before, during, and after completion for documentation and marketing purposes.

These images may be used on the company website, social media platforms, marketing materials, or other promotional channels.

Clients may request in writing that photographs of their property not be used for marketing purposes.


17. Acceptance of Terms

By accepting an estimate, scheduling services, or submitting a form through our website, the Client acknowledges that they have read, understood, and agree to these Terms of Service.
